Information clause

INFORMATION CLAUSE
 
for persons conducting business interested in cooperation
 and who are clients as well as their representatives, proxies, employees

 

This information concerns the personal data which FOLPOLTER II ("the Company"), with its registered office in Jaslo, processes personal data as the personal data controller, the ways of using such data, as well as the rights of natural persons related to the processing of personal data.

In this information clause, the Company, being the controller of personal data ("ADO") informs in particular about the purpose and the manner in which it collects, uses and stores your personal data, about the legal basis on which it processes your personal data, as well as about your rights.

Types of personal data, source of data collection

In connection with the collaboration (the possibility of a partnership) between you and our Company, we may process the personal data you provide, such as:
a) first and last names
b) business and correspondence addresses,
c) numbers in relevant registers (e.g. NIP or REGON numbers),
d) PESEL number,
e) position held by you within your organization,
f) specific identification numbers that are not commonly assigned numbers (e.g. official ID card number);
g) bank account number,
while the scope of the processed data is each time determined by the purposes of the processing.

In the case of concluding a contract directly between you and our Company, the provision of data is voluntary, but necessary for the conclusion and performance of the contract.

Where you do not enter into a contract directly with our Company, providing personal information may be your business obligation.
We may also obtain your personal data from entities with which you are employed or which you represent. The scope of data processed in such a case will include information necessary to perform the contract between the Company and such entity, e.g. information on termination of your employment with the entity, change of contact details or change of position.

Purposes, legal basis and processing periods

Your personal data are processed by ADO for the purposes set out below.
For each purpose, we have provided the legal basis for the processing and the duration of the processing for that purpose.

I.
PURPOSE: to conclude and perform a contract
LEGAL BASIS : Article 6 (1) (b) RODO
PROCESSING PERIOD : the period of performance of obligations and the period of limitation of claims under the law .

II.
PURPOSE: performance of an agreement between the Company and another entity - if you are the persons indicated by this entity as contact persons or representatives of such entity which is a legal person
LEGAL BASIS: Article 6(6)(f) RODO - legitimate interest of the controller, which is the performance of a contract between the Company and another entity, protection of rights, pursuit of claims
PROCESSING PERIOD: the period for performance of obligations and the period of limitation of claims under the law or until the date of consideration of an objection lodged pursuant to Article 21 RODO.

III.
PURPOSE: to comply with a legal obligation to produce and maintain records
LEGAL BASIS: Article 6.1.c of RODO
PERIOD OF PROCESSING: the term of storage of invoices, accounting books and documents confirming the conclusion and performance of the contract resulting from the law.

IV.
PURPOSE: to confirm performance of obligations and to assert or defend against claims
LEGAL BASIS: art. 6 par. 1 letter f) RODO - the controller's legitimate interest in protecting rights, confirming the fulfilment of obligations and obtaining due remuneration therefor
PROCESSING PERIOD: the period for performing the obligations and the period of limitation of claims resulting from the regulations.

V.
PURPOSE: marketing of own services
LEGAL BASIS: Article 6(1)(f) RODO, i.e. the administrator's legitimate interest in informing persons remaining in current relations with the administrator about the administrator's services;
Article 6(1)(a) RODO - separate, voluntarily given consent - in the case of persons not being in current relationship with the administrator.
PROCESSING PERIOD: until the objection raised on the basis of Article 21 RODO is considered or the consent is withdrawn.

Recipients of personal data

Your personal data may be disclosed to our trusted business partners, i.e. entities with whom we cooperate, for the purposes referred to above, including in particular suppliers responsible for operating IT systems and equipment, entities providing accounting and HR services, postal/courier delivery services, marketing agencies, recruitment agencies, debt collection and auditing companies, banks, payment operators and furthermore to authorities or third parties who make a request on an appropriate legal basis.

Data transfer

Personal data will not be transferred to third countries / international organizations.

In relation to the processing of your personal data, you have the following rights:

The exercise of these rights depends on the conditions set out in the RODO. If your request is denied, you will receive a response with the reasons for the denial.

Please note that:

If the processing of personal data is considered to violate the provisions of the RODO, the data subject may lodge a complaint with the supervisory authority, i.e. the President of the Office for Personal Data Protection.
